Communication on getting ready for changes at the end of the transition period

GEN - 1140.00. The European Commission has issued a communication on readiness at the end of the transition period between the EU and the UK. Manufacturers are strongly advised to double-check their readiness, notably with regards to customs, VAT, product requirements and conformity marking.

The UK left the EU on 1 February 2020. EU law continues to apply in the UK during the transition period lasting until 31 December 2020. Businesses must prepare for the end of that transition period.

Customs formalities and taxation

As of 1 January 2021, the UK will no longer be part of the EU Customs Union. Customs formalities will apply to goods entering the EU or the UK. Businesses importing or exporting in the UK or EU must have a valid EORI number, a customs representative where applicable, and a valid Authorised Economic Operators authorisation where applicable.

VAT will be due upon importation of goods brought into the VAT territory of the EU from the UK. EU businesses should get acquainted with the relevant VAT procedures and prepare for their application as of 1 January 2021.

Product requirements and conformity marking

As of 1 January 2021, the Union and the United Kingdom will be two separate regulatory and legal spaces. UK products placed on the EU market will have to comply with EU rules and standards. EU products placed on the UK market will have to comply with UK rules and standards.

Certificates or authorisations issued by UK authorities or by UK-based bodies will no longer be valid for placing products on the EU market. Registration of UK products in EU databases may have to be done by an importer in the EU or an authorised representative in the EU. Authorised representatives based in the UK will no longer be recognised in the EU.

CEN and CENELEC agreed to extend the transition period for the BSI until 31 December 2021.
